General Terms and Conditions

State driver's license or ID card is required to register.  Registrant must be 18 years or older.

Buyer's Premium of 18% will be added to the hammer price, the sum of which shall be the taxable amount. Texas State Sales Tax of 8.25% assessed on invoices.

Tax will be 8.25% unless auction location tax rates differ.

Payment is due upon conclusion of the auction. Bidder authorizes Texmax Auctions, LLC to charge the credit card used at time of registration to remit payment of open invoice. Methods of payment include AMX, VISA, Discover or MC. 

All items sold "As Is Where Is" with no guarantees or warranties.

Auction staff reserves the right to bid and buy any auction items.

Auctioneer and auction team are agents for the seller and will conduct business in his/her best interest.

Buyers agree not to dispute credit card charges.

No buyers shall trade any items on the auction premises.

Buyer is responsible for timely removal of items with no assistance from Texmax Auctions, LLC, or its associates. Auction staff is not responsible for load out or providing any equipment for same.

Any items not picked up by the end of the last day will be considered forfeited and shall revert to the seller with NO REFUND.

*Shipping Terms

To expedite shipping please include the request in the "Notes to Auctioneer" Section when registering.

We do not ship furniture or large items.

At the close of the auction Texmax Auctions, LLC partner affiliate Shipping Saint automatically sends an email and text message; winners will be given the option to select a pickup time OR have winning items shipped.

All costs associated with shipping are passed directly to the receiver.

Shipping costs include; not limited to:

- Fees incurred from carrier and insurance

- Texmax Auctions, LLC associate expenses for time to wrap, pack, and box item(s).

- Costs of materials utilized including boxes, wrapping paper, bubble wrap, foam, other packing materials, tape, any other materials required for transport.

All successful bidders are required to complete ATF Form 4473

Bidders must meet minimum age requirements which are stipulated as at least 18 years of age for long guns and 21 years of age for handguns.

Texmax will not take possession of firearm(s) at any time and is solely acting as an agent for the seller. Upon successful receipt of payment to Texmax Auctions, LLC, firearm(s) will be available for pick up from [FFL BUSINESS NAME]. This Means Texmax is not in possession of any firearm(s) so as to comply with ATF Best Practices. Buyer is responsible for making arrangements to secure possession of firearm(s) from, and must coordinate directly with [FFL BUSINESS NAME] Call for preview and pickup appointments [FFL PHONE NUMBER]

Please note an additional transfer fee of [FFL PREDETERMINED FEE] per firearm will be remanded by and payable to:

[FFL BUSINESS NAME, ADDRESS, PHONE NUMBER]

Texmax does not guarantee, warrantee, or inspect firearms and is not responsible for any loss or damages upon completed transfer of possession to the buyer.

Buyer accepts 100% responsibility for all state, federal, county, municipal, and local laws, rules, regulations, applicable for firearm purchase and ownership.
