PHG Group Pty Ltd Terms and Conditions

Introduction: These Terms and Conditions govern all auctions conducted by PHG Group Pty Ltd. By registering to bid or participating in any auction, you agree to be bound by these terms. Please read them carefully.

Registration and Bidding

1.1 Intending bidders are required to register prior to auction.

1.2 The auctioneer may refuse any bid or withdraw any lot from sale at their discretion.

1.3 The purchaser will be the highest bidder. Any dispute arising as to the highest bidder is to be resolved by the auctioneer who may offer the lot for re-sale.

1.4 In online-only auctions, online bidders win over absentee & phone bids if the bids land on the same increment.

Fees and Payment

2.1 A 16.5% (includes G.S.T) buyer's premium is applicable on purchases through PHG Group Pty Ltd. The buyer's premium is subject to change.

2.2 Full payment is required within 48 hours of the auction's conclusion (unless previously negotiated with the auctioneer).

2.3 Accepted forms of payment are: CASH, DIRECT DEPOSIT, EFTPOS or most CREDIT CARDS. Credit card surcharges may apply. Please contact us for more information.

2.4 All items remain the property of the vendor until payment has been received in full and to the satisfaction of PHG Group Pty Ltd.

Item Description and Condition

3.1 Whilst every care is taken, PHG Group Pty Ltd does not accept responsibility for items described incorrectly, either in catalogues or during the auction. No compensation shall be paid in respect of any description error.

3.2 Intending buyers are advised to take advantage of the times given to view items prior to the auction commencing. Private viewings are available by appointment.

3.3 No allowances or refunds will be made, nor will any buyer be permitted to reject any lot on the grounds that it is not correctly described in any catalogue/auction. Lots are sold and are to be accepted with all faults (if any).

Risk and Insurance

4.1 For all purposes, purchased items will be at the Purchaser's risk from the fall of the hammer.

4.2 None of the items are insured by PHG Group Pty Ltd. At the fall of the hammer, the item becomes the responsibility of the purchaser. We strongly recommend taking out immediate insurance cover on any item of value.

Collection and Delivery

5.1 Payment must be made in full before delivery or collection.

5.2 We offer complimentary packing; however, freight is at the buyer's cost. Please contact us for our preferred transport methods.

General Provisions

6.1 Check individual auctions for any variations to these terms.

6.2 Catalogue/online lots may change without notice and at the discretion of the agent/vendor. This includes the withdrawal of any lots at the agent's/vendor's discretion.

6.3 The auctioneer shall not be liable for any default of the buyer or vendor.

6.4 Terms and Conditions are subject to change.

Governing Law These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Victoria, Australia.

Severability If any portion of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Privacy PHG Group Pty Ltd respects your privacy. Information collected during registration and bidding will be used solely for auction-related purposes and will not be shared with third parties except as required by law.

Definitions

10.1 "Lot": An individual item or group of items for sale at auction. 10.2 "Hammer Price": The price at which a lot is sold, as indicated by the fall of the auctioneer's hammer. 10.3 "Reserve Price": The confidential minimum price acceptable to the seller for a lot.
